2011 SNOW JOE PLUS 322P SWEEPSTAKES - Details of rules and regulations
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
- Eligibility: No purchase is necessary to enter or claim prize. The @SnowJoe Twitter Snow Joe Plus 322P Sweepstakes (the "Sweepstakes") is open only to legal residents of the United States (excluding Puerto Rico) and legal residents of Canada (excluding Quebec) who are 18 years of age or older with a Twitter account. The Snow Joe Company, L.C. Williams & Associates, or other companies associated with the Sweepstakes, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee, are not eligible to enter. The Sweepstakes is subject to all federal, state, provincial and local laws. Void where prohibited or restricted by law or regulations.
- Sponsor: The Sweepstakes is sponsored by The Snow Joe Company, 86 Executive Avenue, Edison, NJ 08817 ("Sponsor").
- Agreement to Official Rules: By entering the Sweepstakes, you indicate your full and unconditional agreement to, and acceptance of, (a) these Official Rules and (b) Sponsor's decisions, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein. Entrants acknowledge that the Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Twitter.
- Entry Period: The Sweepstakes begins at 12:00:01 AM Eastern Standard Time ("EST") on November 15, 2011 and ends at 11:59:59 PM EST on January 2, 2012 (the "Sweepstakes Period"). Entries submitted before or after the Entry Period are not eligible. Sponsor's computer is the official time-keeping device for the Sweepstakes.
- How to Enter: Follow @SnowJoe on Twitter at http://twitter.com/SnowJoe (the "Snow Joe Twitter Page") and tweet why you need an easy-to-use electric snow thrower, using the hashtag #SnowJoePlus. Each tweet counts as one "Entry." You can enter once per day throughout the duration of the sweepstakes. Any attempt by any entrant to obtain more than the permitted number of entries by using multiple/different Twitter accounts, identities, registrations, or logins, or through any other methods, may void all of that entrant's entries and that entrant may be disqualified. In the event of a dispute over the identity of an entrant, the entrant will be the registered owner of the Twitter account. Entries will not be acknowledged.
- Representations and Warranties: By submitting an Entry, you represent and warrant that the Entry complies with all requirements of these Official Rules.
- Drawing: Every Monday at noon EST starting on November 21, 2011 through December 26, 2011 and then again on Tuesday, January 3, 2012 at noon EST, Sponsor will select one (1) potential winner in a random drawing using Random.org from the eligible pool of entries of people who follow @SnowJoe on Twitter and who have tweeted with the #SnowJoePlus hashtag during the entry period. The odds of winning depend upon the number of eligible entries received. Sponsor reserves the right to verify eligibility qualifications of any winner.
- Notification and Requirements of Potential Winners: Sponsor will attempt to notify potential winners by tweet and direct message within ten (10) days of the date of selection, in English only. In order to receive a direct message from Sponsor, you must (a) be following @SnowJoe and (b) have your account settings set to "unprotected" and/or "public." Except where prohibited, a potential winner may be required to complete and return an affidavit of eligibility/prize release form in which he/she irrevocably assigns and transfers to Sponsor any and all rights, title, and interest in Entry, including, without limitation, all copyrights and trademark rights, and waives all moral rights in the Entry. The potential winners will have thirty (30) business days to respond to the tweet and/or direct message with their name and email address. If a potential winner does not respond within thirty (30) business days after the tweet and/or direct message is sent, the Sponsor will select an alternate potential winner in his/her place in a random drawing of all remaining complete and eligible entries. Only three (3) alternate potential winners will be contacted. Upon response, Sponsor will email and/or mail the winners an affidavit of eligibility and liability/publicity release. Winners will be required to sign and return the affidavit of eligibility and liability/publicity release via fax, email or mail to the Sponsor within fourteen (14) days of the date of receiving the documents via email or mail from the Sponsor. If a potential winner fails to sign and return these documents within the required time period, an alternate potential winner may be selected in his/her place in a random drawing of all remaining complete and eligible entries. If a Canadian resident is selected as a potential winner, that person must also answer correctly within a 5 minute time period a mathematical skill-testing question without the benefit of any other human assistance or mechanical or electronic calculating devices before the prize will be awarded. The five-minute period will begin as soon as the skill testing question is emailed to the potential winner. The decisions of the Sponsor are final and binding on all matters relating to the Sweepstakes.
- Prize: Seven (7) winners will receive a Snow Joe Plus 322P electric snow thrower (value $99.99). Winners are responsible for paying any applicable federal, state, local and provincial taxes and all income and any other taxes, fees and surcharges. Any prize details not specified above will be determined by Sponsor in its sole discretion. A prize may not be transferred and must be accepted as awarded. You may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor in its sole discretion.
- General Conditions: In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the prizes according to the procedures set forth above from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the participant. The "authorized account holder" is the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. The Sweepstakes is subject to federal, state, and local laws and regulations and is void where prohibited.
- Release and Limitations of Liability: By participating in the Sweepstakes, you agree to release and hold harmless Sponsor, L.C. Williams & Associates, Twitter, their respective parent, subsidiaries, affiliates, and each of their respective officers, directors, employees and agents (the "Released Parties") from and against any claim, or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use of any prize. You further agree that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney's fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
- Privacy and Publicity: Any information you submit as part of the Sweepstakes will be used for purposes of this Sweepstakes and treated in accordance with Sponsor's Privacy Policy. Except where prohibited, participation in the Sweepstakes constitutes an entrant's consent to Sponsor's use of his/her name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration.
- Disputes: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New Jersey. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New Jersey.
- Results: Winners will be notified via tweet and direct message.
